At EVIQO Technologies Limited ("EVIQO", “EVIPOWER”, "we", “Company”) together with our affiliates, we are committed to protect your privacy and safeguard your personal information. This Privacy Policy describes how we collect, use, and disclose your personal information when you use our website, mobile Application (App), or other services (collectively, hereinafter refer as "Services"). 

We are committed to comply with all Applicable data protection laws and regulations, including the California Consumer Privacy Act (CCPA). By using our Services, you consent to collection, use, and disclosure of your personal information as described in this Privacy Policy. Unless you have read and accepted all of the terms of this Privacy Policy, you are not authorized to use the App.

This Privacy Policy Applies to the services of the App itself and does not Apply to products or services provided by any other third party through the App ("Third party Services"). You should fully understand the product functions and privacy policies of the third party services before choosing to use them.

2. Information

We may need you to provide personal information to us directly, in which case you are generally free to choose which personal information you want to provide to us. However, if some personal information is required for the performance of our Service and you choose not to provide that personal information, we may not be able to provide you with the Service you requested.

1. Personal information required for user registration

When you log in and register an App account for the first time, you are required to provide us
with information including but not limited to:

-Name

-Address including Country, Region, zip code

-Email address

-Phone number

The above information is necessary for you to set and maintain the App.

2. Personal information required to provide Services

2.1 Equipment Information

To provide you with the best possible Service, we may collect and use certain information related to your device, such as:

  • Device model
  • Unique device identifier
  • Operating system
  • Software version
  • Network status
  • IP address
  • Time stamp
  • Time zone
  • Country code
  • Telecom operator
  • EVs/PHEVs model

We collect this information with your permission, which you grant during installation and use of our App. This information is also collected when the App is closed or not in use and is also used to support advertising. This is necessary to ensure the proper functioning of the charging process and effective troubleshooting.

2.2 Location information

We may collect your location information to offer you more personalized and effective support. This information may also be used to properly schedule charging sessions if the time zone information in the settings was entered incorrectly. The collection of this information also occurs even when the App is not in use or is closed, and it may also be used to support advertising efforts. This allows us to offer you location-based services and improve your overall experience with our App. 

Please note that you have the option to turn off location-based services on your mobile device. If you choose to do so, we will stop collecting your location information and you may not be able to use certain location-based features of our App. 

2.3 Log information

To ensure the smooth operation of the App and provide you with the best possible Service, we may collect certain log information automatically when you use the App. This information may include:

-IP address

-Browser type

-Language used

-Date and time of access

-Connection status

-Charger status

-Charging records 

-Request records

We collect this information to help diagnose and troubleshoot technical issues, improve the App and optimize your user experience. This information also allows us to better understand how our users interact with the App, identify areas for improvement, and develop new features and services that meet the needs of our users. This information is also collected even when the App is not in use or has been closed, and it may be used to support advertising efforts.

Please note that we do not share this information with any third parties except as necessary to provide and improve our services, advertising efforts or as required by law. We take Appropriate measures to safeguard this information and protect your privacy. 

3. How We Use Information Collected

We use the information we obtain for purposes outlined below. 

Please note that we will not use your personal information for any other purpose without obtaining your consent, unless we are required to do so by law. We always follow Applicable data protection laws and regulations, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA):

-Managing and improving the content of the App and Services and enhancing your user experience;

-Sending correspondence about the App and Services, order status and processing, other important information including changes to the policies, Terms of Use, as well as newsletters, announcements, and promotional materials on our behalf or on behalf of third parties, including via SMS;

-Providing the App and Services, including facilitating charging sessions;

-Analyzing trends and statistics and improving the chargers operations;

-Enforcing Privacy Policy, Term of Use and any other terms and conditions;

-Maintaining and enhancing the safety and security of the App and Services to prevent any misuse;

-Processing billing functions, including payment fees if any;

-Maintaining and servicing accounts, providing customer service, verifying customer information, сommunicating with you regarding the Services, warranty, providing technical support or enabling you to communicate with other users;

-Complying with Applicable legal requirements, relevant industry standards, and policies; 

-Pursuing or defending against legal claims

-Protecting against fraud, criminal activity and other liabilities;

-Remembering your information so you will not have to re-enter it;

-Managing and enhancing the use of App in other ways to effectively provide the Services.

4. Security

We take the security and privacy of your personal information seriously and have implemented reasonable and appropriate administrative, physical, and technical security safeguards to protect the confidentiality, integrity, and availability of the personal information we collect.

Our security measures are designed to protect your personal information against reasonably anticipated threats and hazards to its confidentiality, integrity, or availability, and against unauthorized, unlawful, or accidental loss, access, use, disclosure, or dissemination.

We regularly review and update our security measures to ensure that they remain effective and in compliance with applicable laws and regulations. We also ensure the secure handling and transmission of all personal and sensitive user data using modern cryptography methods, such as over a secure HTTPS connection.

Please note that the transmission of information over the internet or other public networks is not completely secure, and we cannot guarantee the security of your personal information during transmission. Any transmission is at your own risk. Once we have received your personal information, we will take appropriate technical and organizational measures to protect your personal information in accordance with our security protocols.

We will store your personal information in accordance with the retention period required by applicable laws and regulations. If laws and regulations stipulate different retention periods for the same type of personal information, we will keep the maximum retention period, unless otherwise required by law. Once your personal information is no longer needed for the purposes for which it was collected, we will securely delete or destroy it.

-We use "Secure Socket Layers" or SSL to protect your data and regularly review our information collection, storage, and processing practices to prevent unauthorized access;

-We implement full encryption for information storage and transmission, safeguarding your information from unauthorized access, usage, or disclosure;

-We carefully choose business partners and service providers and implement personal information protection requirements in our contracts and audits with them;

-We provide security and privacy protection training, testing, and publicity activities to enhance our employees' awareness of the importance of protecting personal information;

-We adhere to international and industry-recognized standards to protect your personal information and actively seek relevant security and privacy protection certifications.

In the event of a personal information security incident, we will promptly inform you of the situation and the possible impact of the incident. We will also suggest risk mitigation measures and remedies, and report the incident to regulatory authorities as required by law.

We only collect personal information from individuals who are 16 years old or older. We do not knowingly collect any information from anyone under 16 years of age. If you are under 16 years of age, please do not provide us with any personal information. If we discover that we have inadvertently collected personal information from children under the age of 13 without parental consent, we will take reasonable steps to delete it as soon as possible in accordance with applicable law.

5. Your Rights With Respect to the Personal Information

We respect your right to your personal information, and we are committed to complying with the California Consumer Privacy Act (CCPA) and other related laws and regulations. Below is a list of your legal rights as well as the measures that we take to protect these rights. Please note that, due to security reasons, we may verify your identity before processing your request.

-Right to be informed: We publish this Privacy Policy to inform you of how we process your personal information. We are committed to being open and transparent about how we use your personal information;

-Right to know what personal information we collect: You have the right to know what personal information we have collected including the categories of personal information, the sources of the information, the purpose for collecting the information, and the categories of third parties with whom we share your information;

-You have the right to grant or withdraw your consent for the collection and use of personal information at any time under the CCPA. If you withdraw your consent, we will no longer be able to provide you with the corresponding service for which you have withdrawn your authorization or consent. However, your decision to withdraw your consent will not affect the processing of personal information based on your previous consent prior to the withdrawal. You may also change the scope within which we are authorized to collect your personal information or withdraw your authorization by taking such actions as deleting information or disabling device functions. For the avoidance of any doubts, if your consent is withdrawn, we will ensure the destruction of all collected information, except in cases where retention is required by law;

-You have the right to cancel your account and stop using our App at any time. To cancel your account, simply click on your profile picture tab and select "Delete account." Once the procedure is complete, your account will be deleted;

-You have the right to opt out of (i) the sale or sharing of your personal information and (ii) targeted advertising. 

-You have the right to limit sensitive personal information processing. We only use sensitive personal information that is subject to the CCPA for the following purposes: (i) performing services or providing goods reasonably expected by an average consumer; (ii) detecting security incidents; (iii) resisting malicious, deceptive, or illegal actions; (iv) ensuring the physical safety of individuals; (v) for short-term, transient use, including non-personalized advertising; (vi) performing or providing internal business services; (vii) verifying or maintaining the quality or safety of a service or device; or (viii) for purposes that do not infer characteristics about you.

Please be aware that if you cancel your account, you will no longer have access to any services related to the App and will be unable to retrieve any content or information that you previously browsed, followed, added, or linked. Additionally, we will permanently delete all of your personal information from our systems. For more information please refer to the Section no. 7 below.

6. With Whom We Share Your Personal Information

In order to ensure the stable operation of the App or to achieve the relevant functions, we may share your personal information with the categories of recipients described below.

-We may share your personal information with companies that are related to us, such as parent companies, subsidiaries, and other companies that have common ownership with us. This is for the purposes described in our privacy policy.

-We may share your personal information with third-party service providers who work on our behalf to support our interactions with you or to help us maintain and improve our relationship with you. These service providers may include cloud service providers, IT providers, operating systems and ecommerce platforms, internet service providers, analytics companies, and marketing providers (such as outbound email marketing providers). We and other companies by our request or authorization may contact you to provide specific services, such as identity verification, email distribution, market research, promotions management, warranty extension and payment processing if any.

-We may share your information with third parties in order to provide you with the services or benefits you request, such as shipping and delivery service providers. We may also share your information with third parties upon your request or direction. For instance, if you decide to integrate our product with a virtual assistant (for example Alexa), we may share your personal information with that third-party provider to perform the requested services. -We may share your Personal Information if we are legally required to disclose it to the government or third parties for purposes such as criminal or fraud investigations, national security, law enforcement, or other matters of public importance.

-We may transfer any information we have about you in connection with corporate transactions, such as a change in corporate control (including but not limited to a merger, sale, reorganization, or transaction related to insolvency or bankruptcy proceedings) involving all or part of our company's assets.

If we transfer any information we have about you in connection with a transaction, we will seek assurances from the buyer that your personal data will be used, shared, maintained, and disclosed consistent with the terms of this privacy policy.

We may also disclose your personal data to protect the security of our systems, investigate and resolve disputes, or to assess any potential instances of wrongdoing.

We may also share information that is aggregated or anonymized, meaning that it does not identify any specific individuals, about the usage of our website or App.

We will not sell, distribute, transfer, or lease your personal data to third parties, except as noted above. For the avoidance of any doubts, we do not sell or otherwise distribute any of your sensitive information.

If you want to review or obtain a copy of your personal data that we store, or want to make any corrections to it, or request deletion or limit its use, you can email your request to info@eviqo.io. Please include proper identification and explain the purpose of your request clearly. Our privacy team will carefully review your request and respond to it promptly.

Please note that if you request EVIQO to rectify personal data about you, we may be required by law to preserve such personal information in its current form.

If you are receiving information about the Service or products, special offers, or surveys by email or postal mail, you may opt out of further communications by emailing us at info@eviqo.io. However, we will still send you emails relating to the support, administration, and security of our products and Services.

For the avoidance of any doubts, if you choose to discontinue using our Services and delete your account, you may request the deletion of all collected information, except in instances where retention is required by law.

8. Our Use of Cookies and Automated Data Collection Tools

8.1 Types of cookies and tracking technologies we use

We may use different types of tracking technologies, including cookies, pixels, web beacons, and tags to enhance your experience when interacting with our App and Website.

Specifically, this website uses cookies to make sure you get the best experience with us. You agree that we can send you notifications about the product, product's app and services, order status and processing, pre order information and deals, other important information including changes to the policies, terms of use, as well as newsletters, announcements, and promotional materials on our behalf or on behalf of third parties, including via SMS, emails. 

8.2 Purposes for using these technologies 

We and third parties authorized by us use the aforementioned technologies for various purposes, including remembering user preferences and browsing behavior; enhancing the performance of the App and Services; conducting analytics; offering you personalized content and promotions that may be of interest to you; tracking your activity across online properties to better understand your preferences and interests; conducting advertising on the App during providing the Services and third-party Websites; measuring the effectiveness of our communication with you and advertising campaigns, including analyzing how and when you engage with our emails.

We also use Google Analytics to improve our App and Services, performance, and user experiences. Google Analytics may use cookies and other tracking technologies to provide their services. All these assist in improving our Services (App/Website) and identifying any possible technical issues.

8.3 Your choices 

You can refuse or delete cookies via your browser settings (mentioned above in Section no.8), but this may impair some of our digital properties’ functionality. Opting out of interest-based advertising will not opt you out of all advertising or data collection. To stop any data transmission please refer to the Section no. 7 above.

9. Online Analytics and Tailored Advertising 

We may utilize third-party analytics services, such as Google Analytics, to assist us in analyzing how users interact with our Service. These service providers use the technologies described in the above section to help us evaluate App, Website activity, generate reports on App or Website use and provide us with other services usage. We may also use Google Analytics for advertising purposes, which is further described below. If you wish to prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on for your current web browser

We and our third-party service providers may use device identifiers and other automated =technologies, such as cookie identifiers, to deliver content or customize ads while you are using our Service or on other devices, App or Websites. The ads may be based on the types of websites you visit, the App on your device, or de-identified information about you and your likely interests, based on your activities off of our Service. Our partners or others may also track your activities over time through automated means, collecting information and using it to deliver advertisements to you. You may control and block the cookies used by our Website by adjusting your browser or device settings to refuse the setting of all or some cookies. As a result while interacting with us, you may come across links to external sites or other online services, including those embedded in third-party advertisements or sponsor information that we do not have control over. 10. Amendments to this Privacy Policy

Please be aware that we may change this Privacy Policy at any time at our discretion by updating the modified policy directly. These changes will take effect as soon as they are updated and released, unless otherwise specified. It is recommended that you periodically review this Privacy Policy so that you are aware of any modifications. By continuing to use the App, you agree to the terms of the Privacy Policy in its most current form.

Changes referred to in this section may include, but are not limited to, significant changes in our service mode, ownership structure or organizational structure, changes in personal information processing purposes or types, changes in the way personal information is used, changes in the main object of personal information provision or disclosure, changes in your rights to participate in personal information processing, changes in our contact information or communication channels.
